1. Acceptance of these terms
By creating an account or using FO2U (operated by FO2U Marketplace Sdn Bhd, "FO2U", "we"), you agree to these Terms of Service. If you do not agree, do not use the service.
2. Accounts
You must provide accurate, current, and complete information when creating an account. You are responsible for keeping your password secure and for all activity on your account. Notify us immediately if you suspect unauthorised use.
You must be at least 18 years old to create an account.
3. Our role as marketplace
FO2U is an online marketplace that connects buyers with verified manufacturers. We are not the seller of the products listed on the platform, unless explicitly identified as such. Contracts of sale are formed between the buyer and the seller. FO2U facilitates payment, delivery coordination, and dispute resolution as set out below.
4. Prohibited use
You agree not to:
- List, sell, or attempt to purchase counterfeit, branded resold, illegal, or restricted goods.
- Circumvent the platform (off-platform payments, contact-poaching, ID spoofing).
- Submit false business credentials during verification.
- Use the platform to harass, defraud, or harm other users.
- Attempt to gain unauthorised access to systems, accounts, or data.
- Use automated tools to scrape, copy, or harvest content.
Violations may result in immediate account suspension and forfeit of any pending payouts.
5. Payments and fees
Buyers pay through FO2U checkout. Funds are held by FO2U and released to the seller after the order is marked Delivered and the buyer-protection window has lapsed. Sellers agree to FO2U's commission structure, which is disclosed in the seller dashboard. Fees, payout schedules, and currency conversion (where applicable) are governed by separate seller terms.
6. Refunds and disputes
Refunds are governed by our Returns & Refunds policy. Where buyer and seller cannot agree, FO2U acts as a neutral arbiter and may, at its discretion, refund the buyer from held funds, debit the seller, or split the cost.
7. Intellectual property
FO2U's logo, brand, code, and design elements are our intellectual property. Sellers retain ownership of their listing content (product names, descriptions, images) and grant FO2U a non-exclusive license to display, promote, and reproduce that content on the platform and in marketing channels.
Sellers warrant that all listing content is theirs to share and does not infringe third-party rights. Buyers may not copy or reuse seller content outside the platform.
8. Limitation of liability
FO2U provides the platform "as is". To the maximum extent permitted by Malaysian law, FO2U is not liable for indirect, consequential, or incidental damages arising from your use of the service. FO2U's aggregate liability to any user is limited to the total fees paid by that user in the preceding 12 months.
Nothing in these terms limits liability for fraud, willful misconduct, or where law prohibits limitation.
9. Governing law and jurisdiction
These terms are governed by the laws of Malaysia. Any dispute is subject to the exclusive jurisdiction of the courts of Kuala Lumpur.
10. Changes to these terms
We may update these terms from time to time. Material changes will be notified by email to registered users and through a banner on the site. Continued use after the effective date of a change constitutes acceptance.
